Rules and Regulations

These Rules & Regulations (this "Agreement") govern any membership in D&B RewardsSM Dave & Buster's Rewards membership ("membership") is a program administered by Dave and Buster's, Inc. dba Dave & Buster's ("we," "us," "our," "ours"). Use of or membership in the program at any time subjects the member or user ("you," "your," "yours," "members") to the terms and conditions hereof.

Privacy
Dave & Buster's does not rent or sell member email addresses or information. As a member, the information we capture will be subject to Dave & Buster's Privacy Policy as amended from time to time in accordance with its terms. You may view the current version of the Privacy Policy at: http://www.daveandbusters.com/misc/privacy.aspx.

Eligibility
Limit one membership per person. Open only to legal residents of the US. Void where prohibited or restricted by law. All federal, state and local laws and regulations apply. Dave & Buster's reserves the right to deactivate or cancel any membership or Power Card® at any time. In such cases, Dave & Buster's will attempt, but is not required, to contact the member. Membership is non-transferable.

Membership Card
The Dave & Buster's Power Card® ("card", "membership card", "member's card") and the D&B Rewards Gold card ("Gold card") are the primary proof of membership and must be presented to receive any benefits. If a registered Power Card or Gold Card is lost or stolen, it is the member's responsibility to notify us by calling (866) 685-1456. Dave & Buster's is not responsible for used or redeemed chips or tickets on cards that have not been reported. Replacement cards can be issued at the Power Station or Front Desk.

Benefits
Membership enrollment: To enroll, a Power Card must be registered at the in-store D&B Rewards kiosk. You may also register online at www.daveandbusters.com. However, when registering online, you are not required to submit your Power Card number initially. Important: You must register a Power Card number to redeem any coupons in-store and for full program benefits to apply. Therefore, we strongly encourage you to submit your Power Card number during online registration. If not, you must add it to your Account Profile prior to redeeming any coupons.

For any discount or other benefit to apply, the Membership account number must be registered, active and available at the time of purchase. D&B Rewards benefits are only valid on eligible purchases at any Dave & Buster's store and are not for resale. Membership discounts are not available on purchases of gift cards. MEMBERSHIP BENEFITS DO NOT APPLY IN CONJUNCTION WITH ANY OTHER COUPONS, PROMOTIONS, OR WITH ANY CORPORATE OR PREARRANGED GROUP DISCOUNTS OR SPECIAL EVENTS.

Membership benefits are provided on an "as is" and "as available" basis. Dave and Buster's, Inc., daveandbusters.com, Lee Marketing, Inc., Blue Hornet, Inc., and any of their respective affiliates, directors, officers and agents expressly disclaims all warranties of any kind, whether express or implied.

E-mail Notification of Benefits
Dave & Buster's will attempt to notify eligible members of additional offers throughout their membership via e-mail. We expect members to submit and maintain accurate user information in connection with their D&B Rewards account. Such information includes name, address, e-mail address and telephone number. Members can change their account information by updating their member profile at the D&B Rewards kiosk in stores, or at www.daveandbusters.com. We do not assume any liability for correspondence, mail or e-mail, that is lost, delayed, or misdirected. Members may opt-out of e-mail communications by logging into the member profile and selecting the opt-out status.

D&B Rewards GoldSM Benefits
Rewards members may be eligible for D&B Rewards Gold status at 1,200 purchased and played chips on their registered Power Card. After Gold status is achieved, members must submit their Power Card and have all chips and tickets transferred to a D&B Rewards Gold card. The D&B Rewards Gold card entitles each member to 10% off all game play. Ten percent (10%) off the regular price will be deducted at time of game play when using the registered Rewards Gold Card. Coin operated games, or other games that do not require a Power Card for payment, do not apply. Membership Cancellation
You have the right to cancel your Membership at any time. You can cancel your Membership by calling (866) 685-1456. We may terminate your Membership, including any associated accounts, without notice, for any reason in our sole discretion, including without limitation our belief that continued use of such membership would violate any provisions of this Agreement, applicable law, or otherwise be harmful to our interests.

Changes to this Agreement
We may change the terms of the D&B Rewards policies and these Rules and Regulations at any time by posting notice in the in-store kiosks or at www.daveandbusters.com.

Program Termination
We may terminate any or all of the benefits available through D&B Rewards at any time with or without notice by notice on the company's webpage.
